I normally wear a 38 waist pant, so I'm right at the high end of a Large. Should I go for the Large or the X-Large?

If you're on the high end I'd go with the XL. It's been my experience that TNF gear runs a bit tight so it couldn't hurt to give yourself a bit more room. Also, these pants have velcro adjustment tabs on each side at the waist. So you'll be able to cinch down the XL to fit just right.
