I know the fully packed backpack would be about 26in in height, but if it wasn't fully packed, do you think it would easily pass as a carry on??

You should have no issue using this as a carry on. Ive flown with my 4300 cu in pack (not filled to capacity) multiple times and no one has ever given me grief about carrying it on.
