I regularly use my similar 38L pack stuffed to the max as a carry on with no issues.

Gary, Over the years, Ive fit my 4300 cu in pack into overhead compartments on numerous flights (though it wasnt filled to capacity). This pack is half that size, so you should have no problem using it as a carry on.
