These say they are water proof... but are they actually... the top part btwn the front and back looks like fabric... Does anyone know if they are actually waterproof or resistant?

While I've never owned these, I can make an educated guess based of similar style boots: they are likely waterproof for short amounts of time--like if you stepped into a slush puddle and quickly walked out. As for the height of the waterproof membrane, I don't know. From the picture, it looks like it's gusseted all the way to the top. These are primarily made for snow--not walking in water. If you're using these for snow (with the occasional slush puddle), your feet likely will stay warm and dry. Baffin is a reputable company, and I'm sure backcountry.com would honor a return if you aren't satisfied. (Waterproof is always a fairly subjective word.)
